It the difference between technically having rights and being able to exercise them.
I have the right to walk down dark alleys in the bad part of town, with ropes of diamonds and pearls wrapped around me...but actually doing that would likely not end well, a la Batman origin story...well, aside from the vigilante kid part. And if I tried it, then tried to pull an "I have rights" gambit... self inflicted lethal stupidity.
